CUSTOMER PRIVACY POLICY
SUBJET: Notice regarding Article. 13 Legislative Decree no. 196/2003 – “Personal Data Protection Code.”
Pursuant to Article 13 and in accordance with Article 23 and 24 of the Legislative Decree No. 196 of June 30, 2003, we would like to inform you about the following:
- SOURCE OF DATA:
Your personal data, or those regarding your company or your affiliation, have been collected from you by our employees, agents and collaborators during:
- . business visits or phone calls;
- . direct contact by attending meetings, seminars, courses and exhibitions;
- . your request for offers and order confirmations;
- . communications and transactions following order confirmations.
- PURPOSES OF DATA PROCESSING
The above data are collected, recorded, enlisted, stored and used for functional activities at the conclusion and execution of the contract to supply the customer with transport and/or logistics services, or during negotiation of the above services, including all our undertakings with regard to contact, acquisition, management, order fulfillment, formalization, management and control of customer care as well as to comply with the requirements and administrative obligations, customs or tax laws pertaining to the services that have been purchased by the customer. More specifically, the above data will be processed by JData Srl the data controller, in order to:
- . acquire data and pre-contractual information (preparation and communication of tenders, preparation of documents even from third parties, verification of solvency);
- . manage the normal contractual relationship for the provision of transport services from you or your company or organization;
- . manage and control risks, prevent possible fraud, insolvency or default;
- . perform all the operations required to manage payments
- . prevent and handle possible claims, sale of the debt to a collection agency, take legal action if necessary;
- . manage accounting, administration, financial flows and balance sheet;
- . manage administrative, accounting, legal and tax tasks;
- . set out and present statements and civil, tax and customs documents in accordance to EU and non-EU laws, regulations, standards and directives;
- . manage inventory, logistics and cargo handling;
- . mail technical brochures to inform and update the customer about the services available at JData.
- METHOD OF DATA PROCESSING
The above data will be processed manually or through an electronic communications network, located in Italy or abroad, at the premises of the data processor.
- EXCLUSION OF PROCESSING OF SENSITIVE DATA
None of your data in our possession can be considered as “sensitive data” or “judicial data” as referred to in sections d) and e) of article 4 of the above mentioned Legislative Decree. If there were data of such nature without your written consent, we would delete them immediately.
- NATURE OF TRANSFER
While the transfer of some data needed to manage the contract can be considered optional, it is mandatory that the data required to comply with administrative, customs, tax and law obligations and regulations related to your purchases. Therefore, a refusal to grant data transfer will de facto prevent the dispatch of your orders.
- COMMUNICATION AND DISSEMINATION OR INFORMATION
Personal information referred to in paragraph 1. will not be disclosed or transferred to undisclosed entities, in any possible form, including their transfer for a simple consultation. They may, however, be communicated exclusively to our employees, partners and consultants. Furthermore, they might also be disclosed to third parties entitled to access them by law, regulations and EU legislation, and, to the extent strictly necessary, to those subjects that, again for purposes related to the execution of the contractual relationship stipulated with you or for the establishment of new contractual relationships, have to provide goods and/or perform services or functions on our behalf.
In particular, the data can be communicated to the following subjects:
- . Study of tax consultant, accounting firm;
- . vectors;
- . marketing companies;
- . various companies responsible for debt collection and litigation
- . Maintainers of our IT systems;
- . Suppliers and maintainers of software applications;
- . Webmaster;
The full list of categories of persons to whom the data may be disclosed is available at the headquarters of the owner.
- BODIES THAT CARRY OUT DATA PROCESSING
Our employees and our internal collaborators have been designated “processors” on the basis of their specific roles and work tasks. Therefore, they are entitled to know and process the data you provide, within the limits of their competence and in accordance with the instructions given by the “data controller”.
- TRANSBORDER DATA FLOW
your personal data may be transferred to EU countries and third countries, for the purposes outlined above.
- DURATION OF PROCESSING
Your data will be stored and processed for the time necessary to fulfill all the indicated purposes. Subsequently, it will only be stored for as long as the rules defined by civil and tax legislation apply.
- RIGHTS
At any time, you, your company or your affiliation can exercise your rights to the extent that this is provided for in Article 7 of Legislative Decree No. 196 June 30, 2003, or access your personal information to know how it is used, obtain its cancellation, rectification, modification, updating, integration, or to object by writing to the following address JData Srl, Via L. Art. 7 (Right to access personal data and other rights)
1) A data subject has the right to obtain confirmation as to whether or not personal data concerning him exists, regardless of their being already recorded, and communication of such data in intelligible form.
2) A data subject shall have the right to be informed:
- a) of the source of your personal data;
- a) of the source of the personal data;
- b) of the purposes and methods of the processing;
- c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
- d) of the identification data concerning data controller, data processors and the representative designated as per Section 5 (2);
- e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3) A data subject shall have the right to obtain
- a) updating, rectification or, where interested therein, integration of the data;
- b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
- c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
4) A data subject shall have the right to object, in whole or in part,
- a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
- b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
SUPPLIER PRIVACY POLICY
SUBJECT: Notice regarding Article 13 Legislative Decree no. 196/2003 – “Personal Data Protection Code.”
Pursuant to Article 13 and in accordance with Article. 23 and 24 of the Legislative Decree No. 196 of June 30, 2003, we would like to inform you about the following:
- SOURCE OF DATA
Your personal data, or those that we posses regarding your company or your affiliation, employees and collaborators have been collected from you by our employees, agents and collaborators during:
- . your visits, telephone calls, or inquiries;
- . direct contact at meetings, seminars, courses, exhibitions;
- . transmissions and transactions subsequent to the order;
- . or have been obtained from third parties, such as managers of public lists of addresses, marketing agencies, customers and suppliers.
- PURPOSES OF DATA PROCESSING
The above data will be collected, recorded, organized, stored and used for functional activities at the conclusion and execution of the purchase contract with the supplier or during negotiation of the above contract, including all our pre- and post-award contractual actions aimed at establishing the supplier/buyer relationship, as well as to comply with the requirements and administrative obligations, customs or tax laws pertaining to the contract or sales the supplier has made. More specifically, the above data will be processed by JData Srl, the data controller, in order to:
- . acquire data and pre-contractual information (evaluation of tenders, verification of adequacy and compliance, including preparation of documents from third parties, verification of reliability);
- . manage the normal contractual relationship for the provision of transport services from you or your company or organization;
- . manage and control risks, prevent possible fraud, insolvency or default;
- . perform all the operations required to manage payments;
- . prevent and handle possible claims, sale of the debt to a collection agency, take legal action if necessary;
- . manage inventory, logistics and cargo handling;
- . manage and eventually make use of financing services and support for the supplier.
In addition, they will be processed by JData Srl and the accounting office independent data controllers, in order to:
- . manage administrative, accounting, legal and tax tasks;
- . prepare and present civil and tax statements and documents as provided by EU laws, regulations, standards and directives.
- METHOD OF DATA PROCESSING
The above data will be processed manually or through an electronic communications network, located in Italy or abroad, at the premises of the data processor.
- EXCLUSION OF PROCESSING OF SENSITIVE DATA
None of your data in our possession can be considered as “sensitive data” or “judicial data” as referred to in sections d) and e) of article 4 of the above mentioned Legislative Decree. If there were data of such nature without your written consent, we would delete them immediately.

Personal information referred to in paragraph 1. Will not be disclosed or transferred to undisclosed entities, in any possible form, including their transfer for a simple consultation. They may, however, be communicated exclusively to our employees, partners and consultants. Furthermore, they might also be disclosed to third parties entitled to access them by law, regulations and EU legislation, and, to the extent strictly necessary, to those subjects that, again for purposes related to the execution of the contractual relationship stipulated with you or for the establishment of new contractual relationships, have to provide goods and/or perform services or functions on our behalf. The list of these subjects is available at our head office.

- b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
NOTICE TO POTENTIAL COLLABORATORS
Pursuant to Article13 of the Legislative Decree No. 196 of June 30, 2003, we are to provide all the required information regarding the purposes and methods of the processing of your personal data and the scope of its communication and diffusion, the nature of our data and its transfer.
- a) we inform you that the data you provided will be used solely for recruitment purposes of personnel to be hired in our company and that such data will be processed manually or through an electronic communications network; any sensitive data you provide, will be processed exclusively through paperwork;
- b)The disclosure of personal data is on a voluntary basis, thus, the failure to submit all or part of it will prevent us from being able to fully evaluate the applicant’ s curriculum, thus, hampering his/her hiring;
- c) With regard to your personal data you shall have the right as referred to in articles 8, 9 and 10 of the Legislative Decree 196/2003, which we quote in full:
1) The data subject has the right to obtain confirmation of whether or not personal data concerning him/her, even if they are not yet recorded and their communication is in an intelligible form.
2) The data subject has the right to obtain information about:
- a) the origin of personal data;
- b) the purposes and methods of processing;
- c) the logic applied in case of processing by means of an electronic communications network;
- d) the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
- e) the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
3) A data subject shall have the right to obtain
